1. EarnOn Terms of Use

BY USING OUR WEBSITE OR APP YOU AGREE TO THESE TERMS – PLEASE READ THEM CAREFULLY

Ownership and Operator

These Terms of Use (“Terms” or “Terms of Service”) apply to your use of the EarnOn website (https://earnon.ai) (the “Website”) and EarnOn mobile applications (iOS / Android) (the “App”), provided by:

- For the United States & Global Operations: Bizionic Technologies Midwest Inc., incorporated in Illinois, USA, with its principal office at 6747 N Laporte Ave, Lincolnwood, Chicago Metropolitan Area, Illinois, USA.
- For India: Bizionic Technologies Private Limited, incorporated under the Companies Act, 2013, with registered office at 3rd Floor, Office No 1A, 6-3-1090/B/4, The Grand Building, KFC Building, Raj Bhavan Rd, Somajiguda, Hyderabad, Telangana 500082, India, CIN: U72900TG2022PTC164876.

Collectively, these entities are referred to in this Agreement as “EarnOn,” “we,” “our,” or “us.”

EarnOn is a content monetization and service facilitation platform. We provide the technology infrastructure for:
1. Creators to upload and monetize content;
2. Subscribers to view and pay for content;
3. Service Providers to offer independent services; and
4. Service Consumers to engage such services.

EarnOn acts only as an intermediary and facilitator. Transactions and interactions occur directly between Users, Creators, and Service Providers. We do not endorse, supervise, control, or guarantee content or services, and are not a party to contracts between Users.

If you do not agree with these Terms, you must not use EarnOn.

1. Acceptance of Terms of Use Agreement

By accessing or using EarnOn, you agree to be bound by these Terms and our Privacy Policy. Subscriptions automatically renew unless cancelled. We may modify these Terms at any time. Updates are effective upon publication.

These Terms of Use (“Terms” or “Agreement”) govern your use of the EarnOn website (https://earnon.ai) (the “Website”) and EarnOn mobile applications (iOS/Android) (the “App”), operated by:

For the United States & Global Operations: Bizionic Technologies Midwest Inc., a corporation incorporated in the State of Illinois, with its principal office at 6747 N Laporte Ave, Lincolnwood, Chicago Metropolitan Area, Illinois, USA.

For India: Bizionic Technologies Private Limited, a company incorporated under the Companies Act, 2013, with its registered office at 3rd Floor, Office No. 1A, 6-3-1090/B/4, The Grand Building, KFC Building, Raj Bhavan Road, Somajiguda, Hyderabad, Telangana 500082, India, CIN: U72900TG2022PTC164876.

Collectively referred to as “EarnOn,” “we,” “our,” or us.”

If you do not agree with these Terms or our Privacy Policy, you must not use the Website, the App, or any other service we provide.

We reserve the right, at our sole discretion, to amend these Terms and our Privacy Policy at any time, including to reflect changes in features, business practices, or applicable law. The most current version will be posted on the Website and App and will be effective immediately upon publication. Continued use of EarnOn after such updates constitutes your acceptance of the revised Terms.

We will notify users of material changes via the App, Website, or email.

1. Introduction
These Terms of Use govern your use of EarnOn and form a legally binding agreement between you and us. Key provisions include:
- We can modify these Terms at any time.
- If you purchase a Subscription, it will automatically renew unless cancelled.
- Your rights may vary depending on your jurisdiction.
- Disputes must first be notified to us and are subject to mediation before arbitration or litigation.

2. Interpretation
In these Terms of Service:
a. “EarnOn” refers to the Website and App (including web, iOS, Android, and desktop access).
b. “We,” “Our,” “Us” refers to Bizionic Technologies Midwest Inc. (for U.S. & global operations) and Bizionic Technologies Private Limited (for India).
c. “Business User” means a User who uses EarnOn for commercial purposes, whether acting individually or through representatives, including Referring Users.
d. “Consumer” means all Users who are not Business Users.
e. “Content” includes any material uploaded to EarnOn, including photos, videos, audio, livestreams, data, text, metadata, images, interactive features, emojis, GIFs, memes, and any other material whatsoever.
f. “Contract between Content Provider and Subscriber” means the agreement governing each Creator Interaction.
g. “Creator” means a User who has set up an EarnOn account to post Content for Subscribers to view.
h. “Channel” means a category-specific discussion or service space on EarnOn (such as Guide Connect, Artist Connect, Fitness Connect, etc.).
i. “Creator Earnings” means the portion of a Subscriber Payment payable to a Creator after deduction of platform fees and Applicable Taxes.
j. “Creator Interaction” means an interaction on EarnOn that grants access to a Creator’s Content, including Subscriptions, pay-per-view Content, or direct payments.
k. “Subscriber” means a User who registers and pays to access a Creator’s Content via a Creator Interaction.
l. “Subscriber Payment” means any payment related to a Creator Interaction.
m. “Include,” “Including” means “without limitation.”
n. “Applicable Taxes” means any VAT, GST, sales tax, or equivalent tax legally applicable in the relevant jurisdiction.
o. “Notice/Notify/Notification” means communication via the EarnOn account, email, postal mail, text message, or phone call.
p. “Referring User” means a User participating in EarnOn’s Referral Program.
q. “Subscription” means a Subscriber’s binding agreement to access Content for a defined period, subject to automatic renewal unless cancelled.
r. “Subsidiary” means any legal entity controlled by Bizionic Technologies Midwest Inc. or Bizionic Technologies Private Limited.
s. “Tax” means all forms of statutory governmental charges, levies, duties, or withholdings applicable in any jurisdiction.
t. Key definitions include: Business User, Consumer, Content, Creator, Subscriber, Creator Interactions, Subscriber Payments, Creator Earnings, Applicable Taxes, and User.

Terms of Service” (also called “your agreement with us”) means the legally binding agreement between you and us, which consists of:

1)      Terms of Use;

2)      Acceptable Use Policy;

3)      Contract between Subscriber and Creator;

4)      Refund Policy;

5)      Platform to Business Regulation Terms;

6)      Referral Program Terms;

7)      Complaints Policy;

8)      Copyright & DMCA Takedown Policy;

9)      Appeals Policy;

10)  eWallet Terms and Conditions;

11) Tax & Applicable Charges Policy;

12) Community Guidelines;

13)  “Upload” means to publish, display, post, input, or otherwise share Content on EarnOn.

14) “User” means any person using EarnOn, whether a Creator, Subscriber, or both.

3. We may change the Terms of Service
Where permitted, we may amend any part of these Terms without prior notice:
a. To comply with changes in applicable laws and regulations; and/or
b. To address risks to EarnOn, Users, or third parties.

Other changes will be notified to you, and you may delete your account before they take effect. Continued use constitutes acceptance of the revised Terms.

4. We may change, suspend, or deactivate EarnOn
We may amend, update, suspend, withdraw, or restrict EarnOn at any time, for any reason.

We do not guarantee that EarnOn or its Content will always be available or uninterrupted.

5. Registering with EarnOn
By registering with EarnOn, you agree to these Terms of Service. If you do not agree, you must not register or use EarnOn.

We may reject any account application at our discretion.

To register as a Subscriber:
i. You must be at least 18 years old;
ii. You must be legally capable of entering contracts;
iii. You must be legally permitted to access EarnOn and its Content;
iv. You must not have convictions for serious crimes;
v. You must pay for Creator Interactions when required;
vi. You must not be barred under U.S. or international sanctions;
vii. You must not have unspent convictions or be subject to court orders relating to assault, violence, sexual misconduct, or harassment;
viii. You must not have been previously removed from EarnOn;
ix. You must not appear on the U.S. Treasury Department’s list of Specially Designated Nationals or similar prohibitions;
x. You must comply with all applicable laws and regulations.

To register as a Creator, you must also:
xii. Upload valid ID and photographs;
xiii. Provide bank account or payout method details;
xiv. Select a payout option;
xv. Provide tax registration details if required;
xvi. Submit identity or age verification if requested;
xvii. Set a subscription price for your Content (if applicable);
xviii. Upload Content for Subscribers;
xix. Provide additional information as required by law or regulation.

We reserve the right to permanently remove accounts that do not meet the above requirements.

6. Monitoring and Compliance with Content Guidelines

EarnOn is committed to maintaining a professional and respectful community environment. We continuously monitor content to ensure compliance with legal standards and our platform guidelines. Content creators are responsible for ensuring that the materials they upload do not contain explicit content or promote unprofessional behavior. Subscribers are also expected to adhere to these guidelines and report any inappropriate content or behavior to the platform. We actively discourage any form of unprofessional behavior and explicit content that may contravene applicable laws or platform policies. Your cooperation is essential in maintaining the integrity and safety of our community. We are not responsible for any loss or damage you suffer as a result of how or where you view Content.

7. Content – General Terms

a) Your Content is not confidential, and you authorise your Subscribers to access and view your Content on EarnOn for their own lawful and personal use, and in accordance with any licenses that you grant to your Subscribers.
b) You are legally responsible for all Content you Upload. If you are a Creator and someone else assists you with the operation of your Creator account, this does not affect your legal responsibility. Our relationship is with you, and not with any third-party, and you will be legally responsible for ensuring that all Content posted and all use of your account complies with the Terms of Service.
c) You warrant that, for each item of Content you Upload to EarnOn:
   i. it complies with the Terms of Service and all applicable laws;
   ii. you own your Content (and all intellectual property rights in it) or hold all rights necessary, including licenses, to post and monetise the Content on EarnOn or the subsequent use of that Content by EarnOn;
   iii. if your Content includes or uses any third-party material, you have secured all rights, licenses, written consents and releases that are necessary for the use of such third-party property in your Content and for the subsequent use of that Content on EarnOn and by us;
   iv. the Content is:
       1. of satisfactory quality, taking account of any description of the Content, the price, and all other relevant circumstances including any statement or representation which you make about the nature of the Content on your account or in any advertising;
       2. reasonably suitable for any purpose which the Subscriber has made known to you; and
       3. as described by you.
d) You are liable to and will indemnify us if any warranty in this section of these Terms of Use is untrue. This means you will be responsible for any resulting loss or damage we suffer.
e) We are not responsible for, do not control, and do not endorse any Content you or any other EarnOn User posts. We have no direct control over what your Content may comprise and are not obligated to pre-screen Content. We reserve the right to pre-screen, monitor, or reuse Content. We reserve the right to remove Content that violates our Terms of Service.
f) You agree to act as custodian of records for all Content you Upload to EarnOn.

8. Subscriber Subscriptions and Purchases

This section applies to Creator Interactions including Subscription billing and renewals:
• Creator Interactions are governed by the Contract between Subscriber and Creator. We may moderate Content and we facilitate Creator Interactions by providing the EarnOn platform, but we are not a party to the Contract between Subscriber and Creator or any other contract between a User and a Creator, and we are not responsible for Creator Interactions. Creators are solely responsible for determining any pricing applicable to Creator Interactions.
• All prices appear, and are charged as per the platform described payment mode. Payment providers may charge currency conversion fees.
• Subscriber Payments are exclusive of applicable taxes, which shall be added at the current rate as applicable to Subscriber Payments.
• When a Creator receives Notice that the Creator Interaction has been confirmed, that Creator must perform their part of the Creator Interaction. Creators agree to indemnify us for any breach of this obligation and are responsible for any loss or damage we suffer as a result of such failure.
• Before entering into a Creator Interaction with a particular Creator, Users must add payment information to their account and then click 'Subscribe' on the relevant Creator's account.
• Users authorise us and each Subsidiary to supply payment information details to a third-party payment provider for the purpose of processing Subscriber Payments.
• The payment provider will take: (i) periodic payments for Subscriber Payments which are Subscriptions; and (ii) immediate payments for Subscriber Payments other than Subscriptions. You authorise and consent to each of these payments being debited using your supplied payment information.
• If you provide details of more than one payment method and a Subscriber Payment from the first method fails, we will use the other payment method for the Subscriber Payment.
• When you select 'Subscribe,' you agree to start a Subscription. A Subscription will automatically renew at the current rate (plus applicable taxes). You authorise us to charge you again after each Subscription, unless: (i) your payment is declined and you have not provided another payment; (ii) the Subscription price has increased; (iii) you switched off the 'Auto-Renew' feature on the Creator's account; or (iv) you close your EarnOn account before the new subscription period begins. By selecting 'Subscribe,' you agree to these provisions.
• If you cancel a Subscription, you can view the relevant Creator's Content until the end of the subscription period in which you cancelled, after which no further payments will be taken from you in respect of subscriptions to that Creator's profile (unless you begin a new Subscription).
• You agree not to make: (i) unjustified requests for a refund; or (ii) unjustified chargeback requests of your payment card provider. If we determine that any refund or chargeback request was made in bad faith, we may suspend or delete your User account.
• You can prepay an amount on EarnOn ('Wallet Credits or Coins') which you can later use for Subscriber Payments. Purchases on EarnOn cannot be divided. Wallet Credits are subject to a maximum amount as indicated. Interest will not accrue on Wallet Credits. For further information refer to the Wallet terms and conditions.

9. EarnOn Channel Terms and Conditions

EarnOn provides a platform that facilitates independent content creation and service offerings through various channels, including but not limited to Guide Connect, Artist Connect, Fitness Connect, and Legal Connect. Each channel represents a specific niche or category where independent content creators, service providers, and professionals can engage with users.
1. EarnOn acts solely as a facilitation platform and does not endorse, verify, or guarantee any services, transactions, or content provided.
2. Independent Service Providers: They are independent third parties and not employees, agents, or representatives of EarnOn.
3. No Guarantees: EarnOn does not guarantee quality, accuracy, reliability, or timeliness of any service or content.
4. User Responsibility: Users must exercise due diligence before engaging providers.
5. No Employer-Employee Relationship: Nothing creates an employment relationship.
6. Indemnification: Users and providers indemnify EarnOn against any claims or disputes.
7. Amendments: EarnOn reserves the right to modify these terms.
8. Governing Law: For India, disputes resolved via arbitration in Hyderabad. For U.S. and global users, Illinois courts apply.

10. Creator Payouts Terms
These Payout Terms (“Terms”) govern the disbursement of funds earned by
creators (“Creators”, “You”, “Your”) on the EarnOn platform (“EarnOn”,
“Platform”, “We”, “Us”). By using the Platform and monetizing content, You
agree to the following:
1. Revenue Share
1.1. EarnOn charges a platform fee of ten percent (10%) on all subscriber
payments (“Subscriber Payments”).
1.2. The remaining ninety percent (90%) constitutes the Creator’s Net
Earnings (“Net Earnings”).
1.3. Net Earnings will only be available for withdrawal once reflected in
Your EarnOn account and subject to the holding period outlined in Section 2.
2. Pending Balance and Holding Period
2.1. All Subscriber Payments will be processed by a third-party payment
provider approved by EarnOn.
2.2. Net Earnings credited instantly but shall be subject to a rolling holding
period of five (5) calendar days from the date of each Subscriber Payment,
unless EarnOn determines a longer holding period (up to twenty-one (21)
days) is required for fraud-prevention, regulatory, or risk-control purposes.
2.3. Following completion of the holding period, funds shall transfer to Your
Available Balance for withdrawal.
3. Withdrawal Eligibility and Threshold
3.1. Minimum payout thresholds apply. Withdrawals may only be initiated
once Your Available Balance equals or exceeds USD $25 (or equivalent in
Your selected payout currency).
3.2. Payouts are transacted in USD or other permitted currencies. Your
bank, e-wallet, or payment provider may impose currency conversion fees,
transaction fees, or other charges, which shall be borne solely by You.
3.3. EarnOn may adjust minimum payout thresholds or suspend withdrawals
in cases of suspected fraud, non-compliance, or disputes.
4. Payout Methods
4.1. Payouts may be requested via your wallet transactions.
4.2. Available payout methods include direct bank transfers, international
wire transfers, and e-wallet solutions (such as Wise).

5. Adjustments, Refunds, and Chargebacks
5.1. If a Subscriber successfully seeks a refund or chargeback, EarnOn may
deduct the relevant portion from Your Available Balance or Pending Balance.
5.2. If such adjustments result in a negative balance, EarnOn may offset
future earnings or recover the amount directly from You.
6. Restrictions and Suspension of Payouts
7.1. EarnOn may suspend or delay payouts if:
(a) fraud, money laundering, or unlawful activity is suspected;
(b) You are in breach of the Platform’s Terms of Use or Content Policy; or
(c) disputes, regulatory instructions, or third-party payment provider issues
require suspension.
7.2. EarnOn shall provide notice where legally permissible.
7. Finality of Payments
All payouts are final and binding once transferred to Your designated payout
method. EarnOn shall bear no liability for losses arising after a successful
transfer to Your bank, e-wallet, or other financial institution.
8. Modifications
EarnOn reserves the right to amend these Payout Terms at any time to
reflect operational, legal, or regulatory changes. Continued use of the
Platform constitutes acceptance of the revised Terms.

 

11. Tax Compliance

General:
i. Creators are solely responsible for their own tax affairs. EarnOn and its Subsidiaries:
   - Are not liable for advising you on your tax obligations.
   - Are not responsible for any non-compliance, non-filing, or underpayment of taxes by Creators.
ii. By using EarnOn, Creators warrant that they will report and pay all taxes owed to relevant authorities in their jurisdiction, including income tax, VAT, GST, or other applicable levies.
iii. If you are found non-compliant with tax obligations or are subject to tax-related litigation, inquiries, or investigations connected with your use of EarnOn, we may suspend payouts, freeze your account, or terminate your access.

Jurisdiction-Specific:
- India-based Creators: Must comply with the Indian GST framework. GST numbers must be provided if registered.
- U.S. Creators: Must comply with U.S. federal and Illinois state tax requirements, including IRS Form W-9/W-8 submissions as applicable.
- EU/UK Creators: Must comply with VAT rules as per EU/UK directives.

Compliance Responsibility: You are solely responsible for filing your tax returns and paying any applicable taxes. EarnOn reserves the right to share payout data with tax authorities when legally required.

12. Our Rights and Obligations

a) We may suspend, remove, or block any Content that breaches these Terms or violates law.
b) We comply with legal obligations to promptly remove unlawful Content.
c) We may use AI/ML-driven moderation and automated filters to detect policy violations.
d) We may feature or recommend Creator accounts based on algorithmic matching.
e) We may suspend or delete Content and accounts without liability for related losses.
f) If your account is terminated, we may retain Content or data in line with our Privacy Policy.
g) We may share account or transaction information with regulators, courts, or law enforcement agencies when required.
h) We may update our payment providers at any time.
i) Except for Creator-owned Content, EarnOn owns all rights to the platform, software, and anonymized usage data.
j) We reserve full discretion in communicating with you through in-app messages, emails, or other contact methods.

13. What We Are Not Responsible For

EarnOn provides services with reasonable care and skill but disclaims liability for:
- Content posted by Users (accuracy, legality, reliability).
- Compatibility of EarnOn with every device, browser, or OS.
- Internet outages, system downtime, or third-party disruptions.
- Unauthorized access, account theft, or fraudulent use of accounts.
- Recording or redistribution of Content in breach of Terms.
- Any implied warranties not expressly set forth in these Terms.
- Loss of data, business opportunity, profits, revenue, or goodwill.

14. Suspension or Termination of Accounts and Content

a) Accounts may be suspended or terminated with 30 days’ notice, or immediately in cases of serious breaches.
b) Without prior notice, we may:
   - Suspend/delete accounts or Content.
   - Pause Subscriber Payments.
   - Withhold Creator Earnings.
   - Refund or cancel Subscriber Payments.
c) Grounds include: serious/repeated breaches, suspected fraud, or illegal activity.
d) Earnings from fraudulent or unlawful transactions may be forfeited.
e) Users may dispute terminations or forfeitures via our Complaints or Appeals Policy.
f) If legal encumbrances (liens, levies) exist on payouts, we may withhold payments until resolved.

15. Intellectual Property Rights – Ownership and Licenses

a) You confirm that uploaded Content does not infringe third-party IP rights.
b) You grant EarnOn a perpetual, worldwide, royalty-free, sublicensable, transferable license to use, reproduce, display, distribute, and adapt Content for platform operations.
c) You waive any moral rights to object to Content treatment where legally permitted.
d) We will not sell Creator Content to third parties, but in case of merger, acquisition, or asset transfer, licenses may be transferred.
e) We may act on your behalf to file DMCA or other takedown notices but are under no obligation to police infringements.


16. Co-Authored Content
a) You are legally responsible for all Content you Upload. You may Upload Content that features someone other than you ("Co-Authored Content").
b) You warrant that each individual in Co-Authored Content you Upload is:
   i. a Creator you have tagged using the tool available on EarnOn; or
   ii. an individual at least 18 years of age whose proof of identity and whose written, informed consent you have obtained to share the Content on EarnOn.
c) You and each Co-Author will provide us with necessary documents to confirm you have satisfied the requirements of these Terms of Service.
d) If you, or anyone appearing in Co-Authored Content, do not provide any information we request, we may restrict or delete the Co-Authored Content or your account, and/or withhold all or any portion of your Creator Earnings.
e) We are not a party to any agreement that you have to create Co-Authored Content or any resulting dispute. All claims arising from Co-Authored Content shall be made against the Creator(s) who posted or who appear in the Co-Authored Content. You will not make any claims against us, and you release us from any claims against us, arising from Co-Authored Content.
f) Any individual(s) who appear in the Co-Authored Content may, at any time, withdraw their consent to appear in that Co-Authored Content. Co-Authored Content may be deleted where a participant withdraws consent.

17. Sharing and Linking To/From EarnOn

a) Other online platforms may allow Users to connect their EarnOn account and share Content. You remain bound by the EarnOn Terms of Service and that platform's terms of service when sharing content in this way.
b) Links to EarnOn:
   • Do not link to EarnOn in a way that is deceptive or that suggests any form of association, approval, or endorsement on our part.
   • Any link promoting your Creator account must comply with our Terms of Service and the terms of service where you advertise.
   • Do not promote your EarnOn account using Google Ads or any similar advertising platform or search engine advertising service.
c) Links from EarnOn: Links on EarnOn to other websites are provided for your convenience only. We are not liable for, do not control, approve of, or endorse those linked websites or the information they contain.
d) Domain Names: You may register or use domain names that contain the EarnOn trademark or a confusingly similar term only if:
   • The domain name is registered by the Creator;
   • The domain name redirects to the Creator's EarnOn account; and
   • The Creator obtains written permission from EarnOn by contacting support@earnon.ai and signs a licensing agreement.

18. Advertising on EarnOn
If you Upload Content to your Creator account which is designed to promote, directly or indirectly, third-party goods or services, in return for payment or other valuable consideration (together "Advertising Content"), then you must ensure that the Advertising Content:
a) is not illegal, prejudicial, threatening, false, fraudulent, harmful, hateful or in violation of our Acceptable Use Policy or Community Guidelines;
b) does not advertise cigarettes, other tobacco products, electronic cigarettes, illegal drugs, or any prescription-only medicine;
c) does not advertise, promote, or facilitate illegal gambling;
d) does not direct any Advertising Content for alcoholic drinks at minors or encourage excessive consumption of alcohol; and
e) does not promote or allow content that is explicitly forbidden under the laws of the country of operation.

19. Transparency Requirements
Advertising Content: Clearly and conspicuously label Advertising Content you Upload to EarnOn by including in the caption of the Advertising Content:
   I. a signifier such as #ad, #paidpromotion or #sponsored; and
   II. the name of the brand advertised and who paid for the Advertising Content.
AI Generated Content: AI Generated content must comply with our Terms of Service and must be clearly and conspicuously captioned as AI Generated Content with a signifier such as #ai, or #AIGenerated.

20. Account Deletion

a) You may delete your EarnOn account in the 'User Account' section of your EarnOn account.
b) If you are a Subscriber, we may delete your account within a reasonable time and will not charge any further Subscriptions. After we delete your account, you will not have access to your former account or any Content.
c) If you are a Creator, your account will remain open until all active Subscriber Subscriptions expire. We will then pay all unpaid Creator Earnings and delete the account. All subscriptions will be deleted and cannot be renewed. After we delete your account, you will not have access to your former account or its Content. Deleting your EarnOn account will not automatically delete Co-Authored Content posted by another Creator.
d) After your account is deleted, we may deal with your data in accordance with our Privacy Policy.


21. Responsibility for Alleged Loss or Damage

a) Consumers:
- EarnOn, its subsidiaries, employees, and agents are not liable for indirect losses such as lost profits, revenue, or opportunities.
- For U.S. consumers: EarnOn’s liability is capped at USD $250 per claim.
- For non-U.S. consumers: Mandatory consumer protections under local law prevail where applicable.

b) Business Users:
- All implied warranties and conditions are excluded to the fullest extent permitted by law.
- EarnOn is not liable for indirect or consequential damages, including loss of business, goodwill, or data.
- Total liability for all claims is limited to the greater of:
   i. 100% of total fees paid by the Business User to EarnOn, or
   ii. USD $5,000.

c) EarnOn is not liable for:
- Unauthorized account access, breaches caused by doxing, or distribution of Content in violation of the Terms.
- Any delay or failure caused by events outside EarnOn’s reasonable control.

22. General

a) If any clause of this Agreement is found invalid, the rest remains enforceable.
b) Failure to enforce rights does not waive them.
c) EarnOn and its subsidiaries reserve all rights not expressly granted.
d) No agency, partnership, or employment relationship is created by these Terms.
e) Third parties do not have rights under these Terms, except EarnOn subsidiaries and employees who may enforce liability limitations.
f) You may not assign or transfer your rights; EarnOn may assign or delegate obligations.
g) These Terms constitute the entire agreement, superseding prior understandings.
h) Complaints must follow EarnOn’s Complaints Policy; appeals must follow the Appeals Policy.

23. Governing Law and Dispute Resolution

For Consumers (India):
These Terms are governed by the laws of India. Any disputes shall be settled by binding arbitration under the Arbitration and Conciliation Act, 1996, with the seat and venue in Hyderabad, India.

For Consumers (United States & Global):
These Terms are governed by the laws of the State of Illinois, USA, and applicable U.S. federal law. Exclusive jurisdiction and venue for disputes shall lie in the state and federal courts of Chicago, Illinois, USA.

For Business Users (India):
If you are a Business User established in India, these Terms are governed by the laws of India, and any disputes shall be resolved by binding arbitration under the Arbitration and Conciliation Act, 1996, seated in Hyderabad, India.

a) Choice of Law and Jurisdiction (Default Rule for All Other Users):
Except as expressly set forth above, these Terms of Service and any disputes arising from or relating to them, including their interpretation, validity, breach, or termination, shall be governed by and construed in accordance with the laws of the State of Illinois, USA, without regard to conflict of law principles. You agree that any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Chicago, Illinois, USA, and you consent to the personal jurisdiction of such courts.

b) Global Compliance Carve-Out:
Notwithstanding the above, you may have non-waivable rights under mandatory consumer protection, tax, or data protection laws of your country of residence. Where such rights apply, they shall prevail over this Choice of Law clause to the extent required by law.


c) Choice of Law Clause (Global Default): All Terms of Service shall be governed by the laws of the State of Illinois, USA, without regard to conflict of law principles.

d) Global Compliance Carve-Out: Mandatory consumer protection, tax, or data laws in your home jurisdiction may override these Terms where required by law.

24. Final Provisions

a) If any provision is found unenforceable, the rest shall remain in effect.
b) No waiver unless expressly granted in writing.
c) Assignment rights: we may assign our rights/obligations; you may not without consent.
d) Entire agreement: these Terms supersede all prior agreements.
e) Complaints & Appeals: refer to our Complaints Policy and Appeals Policy.

2. ACCEPTABLE USE POLICY

BY USING OUR WEBSITE OR APP YOU AGREE TO THIS POLICY – PLEASE READ IT CAREFULLY

This Acceptable Use Policy (“Policy”) sets out what is and is not permitted on EarnOn and forms part of your agreement with us. Any breach of this Policy may result in suspension, restriction, or deactivation of your Content and/or your account.

Defined terms in this Policy have the same meanings as in our Terms of Use.

1. Protection of Minors

You must not feature, engage with, or facilitate anyone under the age of 18. You must not feature any person over the age of 18 in explicit content unless they have completed EarnOn’s Creator onboarding process or provided a properly completed release form.

2. Illegal Activities

You must not use EarnOn to engage in, promote, or facilitate any illegal activity under the laws of the jurisdiction where you use the platform. This includes, but is not limited to, exploitation, abuse, trafficking, or harm of individuals.

3. Prohibited Items

Possession, use, or promotion of prohibited items (including weapons, explosives, or controlled substances) in a manner that threatens or may cause harm to yourself or others is strictly forbidden.

4. Hateful Conduct

You must not attack, threaten, or demean others based on race, ethnicity, national origin, caste, sexual orientation, gender, gender identity, religious affiliation, disability, age, or disease.

5. Abuse and Harassment

You must not stalk, harass, defame, or dox others. You must not share non-consensual images, manipulated or fake intimate images, or otherwise unauthorized content.

6. Violence or Harm

Content involving extreme violence, coercion, prohibited roleplay, harmful use of objects, extreme bondage, or depictions of suicide is prohibited. All interactions must be consensual and free from physical or psychological harm.

7. Prohibited Bodily Fluids

Content involving urine, feces, or other prohibited bodily fluids is not allowed.

8. Accuracy of Information

You must not misrepresent or provide false information about your identity, account details, or the nature of your Content. Misleading descriptions of media are prohibited.

9. Non-Consensual or Artificial Content

You must not upload explicit images of another person without their consent, including artificially generated or manipulated images.

10. Cyber Misconduct

You must not engage in spamming, phishing, or malware distribution. You must not share other people’s personal data without authorization. Linking to off-platform sites that violate our Terms of Use, or interfering with EarnOn’s software, hardware, or network, is prohibited.

11. Copying or Scraping Content

You must not scrape, copy, download, or share EarnOn Content, whether from the platform or other Creators, for any unauthorized purpose.

12. In-Person Meetings

You must not use EarnOn to arrange or facilitate in-person meetings or transactions outside of approved Creator Interactions.

13. Prohibited Commercial Activity

You must not use EarnOn to sell controlled or regulated items. You must not imply or represent that EarnOn has endorsed you or your Content without written authorization. You must not infringe or misuse any third-party intellectual property rights.

3. CONTRACT BETWEEN SUBSCRIBER AND CREATOR

1. Introduction

This Contract between Subscriber and Creator ("Agreement") governs each interaction between a Subscriber and a Creator on EarnOn.

2. Scope

This Agreement is legally binding and applies each time a Creator Interaction is initiated on EarnOn. It applies to the exclusion of any other terms which either the Subscriber or Creator may propose.

3. Parties

The only parties to this Agreement are the Subscriber and the Creator participating in the Creator Interaction. The Company and/or its Subsidiaries are not parties to this Agreement or any Creator Interaction except as expressly provided.

4. Interpretation

In this Agreement:
- Company: Bizionic Technologies Pvt Ltd (India) and Bizionic Technologies Midwest Inc. (US/Global).
- Content: Any material uploaded to EarnOn by a User, including photos, videos, livestreams, audio, text, metadata, images, GIFs, memes, or any other material.
- Creator: A User who has set up an EarnOn account to post Content for Subscribers.
- Creator Earnings: The portion of a Subscriber Payment payable to a Creator after deduction of EarnOn’s platform fee and Applicable Taxes.
- Creator Interaction: Any interaction on EarnOn that grants access to a Creator’s Content, including Subscriptions, pay-per-view, tips, or direct messages.
- Creator Interaction Licence: The non-transferable, non-sublicensable, and non-exclusive licence granted by a Creator to a Subscriber to access Relevant Content.
- Subscriber: A User registered with EarnOn who accesses Content via a Creator Interaction.
- Subscriber Payment: Any payment made by a Subscriber for a Creator Interaction.
- Platform Fee: 10% of all Subscriber Payments, deducted in accordance with the Terms of Use.
- Applicable Taxes: Any taxes imposed by relevant authorities in any jurisdiction.
- Paid Relevant Content: Content that requires Subscriber Payment for access.
- Referring User: A User participating in EarnOn’s referral program.
- Relevant Content: Content to which a Creator Interaction relates.
- Subscription: A Subscriber’s binding agreement to access all Content a Creator makes available for a recurring period in exchange for authorised automatic renewal payments.
- Subsidiary: Any legal entity owned or controlled by the Company.
- Tax: All forms of taxes, duties, levies, charges, withholdings, or liabilities.
- Upload: To publish, display, post, or otherwise share material on EarnOn.
- User: Any registered user of EarnOn, whether a Creator, Subscriber, or both.

5. Pricing and Payment

The Subscriber agrees to pay the applicable Subscriber Payment plus Applicable Taxes. The Company is authorised to deduct the Platform Fee and referral payments, and to pay out Creator Earnings.

6. Subscriptions and Renewals

By selecting "Subscribe," the Subscriber agrees to start a Subscription that will automatically renew at the current rate (plus Applicable Taxes). The Subscriber authorises the Company to charge renewal payments unless: (i) payment fails; (ii) the price has increased; (iii) auto-renew has been switched off; or (iv) the account has been closed before renewal. No additional renewal notices will be sent.

7. Licence of Content

As part of a Creator Interaction, the Creator grants a Creator Interaction Licence that permits the Subscriber to access Relevant Content.

8. Ownership of Content

The Creator Interaction Licence does not grant Subscribers any ownership rights to Relevant Content.

9. Expiry of Licence

The Creator Interaction Licence automatically expires without notice if:
a. Subscriber Payment is unsuccessful, reversed, or charged back;
b. the Creator deletes the Content or account;
c. the Subscription ends;
d. the Subscriber’s account is suspended or terminated;
e. the Subscriber breaches the Terms of Use;
f. Relevant Content is removed or account is suspended; or
g. the Subscriber closes their account.

10. Removal of Content

The Company and Creators may remove Content, including pay-per-view Content, at any time. Subscribers acknowledge this risk.

11. Cancellation and Refunds

a. Subscribers gain access to Relevant Content within 14 days of payment.
b. The statutory cancellation rights under the Indian Consumer Protection Act, 2019 do not apply once Content access is granted (except for Subscriptions).
c. Subscribers may have refund rights under applicable consumer protection laws in their jurisdiction.
d. Cancellations and refunds are also subject to the Terms of Use.

12. Obligations between Creator and Subscriber

a. Both parties must comply with the Terms of Use.
b. The Creator is solely responsible for creating and publishing Content.
c. The Creator warrants all rights necessary to license the Content.
d. The Creator must provide Paid Relevant Content once payment is made.
e. The Subscriber acknowledges Creators may use third parties to assist in account operations.
f. The Subscriber must make payments as required for access.
g. The Subscriber must not initiate chargebacks in bad faith.
h. The Subscriber assumes risks of accessing Content, except where caused by Creator negligence or breach.

13. No Guarantees

Subscribers acknowledge that access to Relevant Content may be interrupted or unavailable, including where EarnOn is suspended or inaccessible.

14. Applicable Law and Forum for Disputes

i. Choice of Law: This Agreement is governed by the laws of India, to the extent permitted by the laws of the Subscriber’s place of residence. Mandatory local consumer laws may also apply.

ii. Forum Selection: Disputes shall be resolved exclusively by arbitration in Hyderabad, India, under the Arbitration and Conciliation Act, 1996. The seat and venue shall be Hyderabad, India.

15. Severability

If any provision of this Agreement is found unenforceable or invalid by a competent court, the remaining provisions shall continue in full force and effect.

 

4. Refund Policy

Effective Date: August 2025

This Refund Policy explains when and how refunds may be issued on the EarnOn platform. It forms part of your agreement with EarnOn (owned and operated by Bizionic Technologies Midwest Inc. in the U.S. and globally, and Bizionic Technologies Private Limited in India). By using EarnOn, you agree to this Refund Policy along with our Terms of Use and other platform policies.

1. General Policy

- Payments made on EarnOn are generally non-refundable once a transaction has been completed.

- Refunds may only be issued in specific cases outlined below, in compliance with applicable consumer protection laws.

- This policy applies to subscriptions, one-time content purchases, tips, services, and in-app wallet transactions made on EarnOn.

2. Eligible Refund Scenarios

- Unauthorized Transactions – if your account or payment method was used fraudulently, reported within 7 days.

- Duplicate Charges – if you were charged more than once for the same transaction.

- Failed Delivery of Services – if a Creator fails to deliver content or services after payment.

- Legal Requirement – refunds will be provided where mandatory consumer laws require them (e.g., EU 14-day withdrawal right for digital services not yet consumed).

3. Non-Refundable Transactions

- Payments for content or subscriptions already accessed or consumed.

- Voluntary cancellations of active subscriptions before the billing cycle ends.

- Tips, donations, or contributions voluntarily made to creators.

- Account terminations due to violation of EarnOn policies.

- Expired wallet balances where applicable.

4. Refund Requests

- Requests must be submitted to support@earnon.ai with transaction ID, payment receipt, and reason for refund.

- Requests must be made within 14 days of the transaction unless otherwise required by law.

5. Processing of Refunds

- Refunds will be processed using the original payment method whenever possible.

- Refunds may take 7–14 business days depending on provider/banks.

- EarnOn may withhold refunds in cases of suspected abuse or chargeback misuse.

6. Chargebacks

- Users are discouraged from raising unjustified chargebacks.

- Bad faith chargebacks may result in account suspension or termination.

7. Wallet Credits (EarnOn eWallet)

- Wallet top-ups are non-refundable unless required by law.

- Unused credits may be refunded on account closure, subject to applicable fees.

8. Jurisdiction & Compliance

- India – Governed by the Consumer Protection Act, 2019, and RBI guidelines.

- United States – Complies with state-level refund regulations and FTC Act.

- EU/EEA – Refunds comply with the Digital Services Directive and consumer withdrawal rights.

- Global – Users may rely on mandatory consumer protection laws in their jurisdiction.

- In the United States & Global Operations: EarnOn, operated by Bizionic Technologies Midwest Inc. (Illinois, USA), complies with U.S. federal and state laws, and global best practices on fairness and transparency.

Key points:
a) All Users must abide by our Terms of Use, comply with applicable local laws, and meet their tax obligations.
b) EarnOn may, at its discretion, promote or recommend Creators.
c) These Terms outline how Business Users (Creators) may submit complaints and pursue dispute resolution globally.

2. Interpretation

Unless otherwise defined in these Platform to Business Regulation Terms, capitalised terms have the same meaning as in the Terms of Use.

3. Applicability

These Terms apply to all Creators and Business Users worldwide.
- India-specific provisions apply to Creators established or resident in India.
- U.S. & Global provisions apply to Creators established in the United States or elsewhere outside India.

4. Promotion and Recommendations

EarnOn may promote Creators via official social media accounts and recommend certain Creator accounts to Users.

5. Complaints

Business Users may submit complaints to support@earnon.ai regarding:
a) Alleged non-compliance with applicable Platform to Business obligations;
b) Technological issues relating to EarnOn services; or
c) Measures taken by us, or our conduct, directly affecting your EarnOn use.

6. Complaint Handling Process

We will:
a) Review your complaint and request additional details if necessary.
b) Process complaints within a reasonable time, considering importance and complexity.
c) Communicate outcomes clearly via email or your EarnOn account.

7. Mediation Service

If complaints are not resolved internally, you may seek independent mediation.
Both parties must act in good faith during mediation.
Mediation does not affect your or our rights to pursue legal proceedings before, during, or after mediation.

8. Dispute Resolution and Governing Law

Choice of Law

These Terms of Service and any disputes arising from or relating to them shall be governed by and construed in accordance with:

1.      India

o    Jurisdiction: Courts in Hyderabad, Telangana, India.

o    Disputes shall be settled by binding arbitration under the Arbitration and Conciliation Act, 1996, with a sole arbitrator jointly appointed by the parties.

o    The seat and venue of arbitration shall be Hyderabad, India, and the language shall be English.

2.      United States & Global Users

o    Jurisdiction: The state and federal courts in Chicago, Illinois, United States shall have exclusive jurisdiction over any disputes.

o    For non-U.S. global users, this does not deprive you of the right to rely on mandatory consumer protection rights in your home jurisdiction.

3.      General

o    Nothing in this section prevents either party from seeking interim or injunctive relief in any competent court where necessary to protect intellectual property rights, confidential information, or to prevent irreparable harm.

EarnOn has established a grievance redressal process to ensure compliance and fairness across India, the United States, and all global operations.

6. REFERRAL PROGRAM TERMS

In compliance with the Consumer Protection Act, 2019 (India), the U.S. Federal Trade Commission Act (FTC Act), and international laws on unfair trade practices, please carefully read the following warnings regarding the EarnOn Referral Program:

a) It is illegal for us or for a participant in the EarnOn Referral Program (including Referring Users and Referred Creators) to persuade anyone to make a payment by promising benefits from getting others to join the program.
b) Do not be misled by claims that high earnings are easily achieved from participation in the Referral Program.
c) Participation in the Referral Program is free of charge. We do not demand any payment for participation.
d) You have the right to cancel your participation in this contract within 14 days under applicable consumer protection law.

1. Introduction

These Referral Program Terms are additional terms that apply if you use the EarnOn Referral Program. They form part of your overall agreement with EarnOn.

Key points:
- You must always comply with our Terms of Use, all applicable laws, and tax regulations.
- You must have a valid User account to participate.
- Referring Users are entitled to a 5% referral payment on Fan Payments generated by the Referred Creator in the first 12 months after the Creator registers, capped at the equivalent of USD $600,000 (or equivalent in other currencies) per Referred Creator.
- We may withhold referral payments or terminate accounts for breaches of EarnOn’s Terms of Use.

2. Interpretation

- Referring User: also referred to as 'you' or 'your.'
- Referred Creator: a new Creator who joins EarnOn using a Referring User’s unique referral link.
- Fan Payments: all payments generated by a Creator’s Subscribers.
- Applicable Taxes: all taxes required in relevant jurisdictions (GST in India, Sales/Income Tax in the U.S., VAT in other countries).

3. The Referral Program

EarnOn offers a program by which Users may introduce new Creators to the platform and receive referral payments under these Terms.

4. Referral Program Rules

a) Ineligible Users: Suspended/terminated/deleted accounts cannot participate.
b) Payout setup: You must add a valid bank account or payout method.
c) Referral link: Each User has a unique referral link. You must not impersonate EarnOn or use paid advertising (e.g., Google Ads) to promote links.
d) Registration: The Referred Creator must click and register via your unique referral link in the same browser with cookies enabled.
e) Creator-only: Referral payments apply only to Referred Creators, not to Fan accounts (unless that Fan later becomes a Creator).
f) One account: Only the first registered account of a Referred Creator counts.
g) Related accounts: No payments for accounts owned/operated by you or commercial partners. We may request verification.
h) Promotion: You must not mislead about EarnOn or claim specific earnings.
i) Withdrawal: A Referred Creator may withdraw from the program at any time.

5. Referral Payments

a) Calculation: You will receive the lesser of:
   - 5% of Fan Payments generated by the Referred Creator in the 12 months after registration; or
   - USD $600,000 (or equivalent currency) per Referred Creator.
b) Examples:
   - If a Referred Creator generates USD $12,000,000 in Fan Payments in 12 months, you earn USD $600,000 (cap).
   - If they generate USD $100,000, you earn 5% = USD $5,000.
c) Taxes: Payments are inclusive of Applicable Taxes.
d) Payout methods: You must choose a payout method available in your country.
e) Frequency: Referral payments are credited monthly, around the 1st of the following month.
f) Costs: The referral fee is borne by EarnOn, not deducted from the Creator.

6. Our Rights

a) Verification: We may request ID or other documents before paying referral fees. Failure to comply may forfeit payments.
b) Program changes: We may modify or discontinue the program, but no change will affect referral payments already earned.

7. Withholding of Referral Payments

The same rules for withholding/forfeiture of Creator Earnings in the Terms of Use apply to referral payments. We may withhold if there is fraud, abuse, or breach of policy.

2. The “Report” function on the Content page.
3. Emailing support@earnon.ai.
4. Writing to our registered offices in India or the U.S. (see Section 2).

You must provide enough information (including relevant URLs/screenshots) for us to investigate. If information is missing, we may not be able to consider your complaint.

7. How We Review Complaints

When reviewing complaints:
- We will examine the information and supporting documents provided.
- We may request additional information from you or third parties.
- We will review complaints in good faith and within legally applicable timelines.
- If Content materially violates our Terms of Use, we will remove it.
- We will notify you of the outcome. If Content is not removed, you may appeal under our Appeals Policy.

8. Abuse of Complaints Process

We do not tolerate complaints made in bad faith, or those that are abusive, harassing, or malicious.
- Abuse of this process may lead to termination of your EarnOn account.

11. Regulatory Compliance (India)

EarnOn is primarily regulated under the Information Technology Act, 2000, and subject to applicable rules, guidelines, and directives issued by MeitY and other Indian regulators.

12. Regulatory Compliance (U.S. & Global)

- In the United States, EarnOn complies with the FTC Act and applicable federal/state laws, including prohibitions against unfair or deceptive trade practices.
- Globally, EarnOn complies with applicable consumer protection and online safety regulations in jurisdictions where it operates.

13. Breach of Contract Claims

- Indian users may bring breach of contract claims under the Consumer Protection Act, 2019.
- U.S. users may pursue remedies under contract and consumer protection laws of Illinois and applicable federal laws.
- EEA users retain statutory rights under EU law.

14. Statutory Rights

Nothing in this Policy affects your statutory rights as a consumer under applicable laws.

3. Abuse of DMCA Notice Process

Misrepresentation in a DMCA Notice or Counter-Notice may result in liability for damages, costs, and attorney’s fees under 17 U.S.C. §512(f), the IT Act (India), and international law. EarnOn will act against abusive use of takedown procedures.

4. Takedown Procedure

Upon receiving a valid Notice:
- We will expeditiously remove or disable access to the infringing content.
- The affected User will be notified.
- Repeat infringers may have their accounts terminated.

If a Notice is incomplete, EarnOn may request additional information.

5. Counter-Notification Procedure

If your content is removed and you believe this was an error, you may submit a Counter-Notification. It must include:
a) Identification of the material removed and its prior location (URL).
b) A statement under penalty of perjury that removal was due to mistake or misidentification.
c) Your name, address, telephone number, and email.
d) Consent to jurisdiction of the appropriate U.S. Federal District Court (if outside the U.S., any district where EarnOn is found).
e) Acceptance of service of process from the complainant or their agent.

Unless the original complainant files a lawsuit within 10–14 days, the content will be restored.

6. International Compliance

- India: In addition to DMCA, takedowns are processed under the IT Rules 2021. EarnOn will remove or disable unlawful content within timelines required by Indian law.

- EU/EEA: Users may also file complaints under the EU DSA with their country’s Digital Services Coordinator.

- Suspend, terminate, or restrict the ability to monetize Content.

4. Use of this Policy

This Policy may be used:
1. By EarnOn Users who want us to review or reverse a Decision.
2. By non-EarnOn Users (e.g., individuals in India, U.S., or globally) who complain about suspected illegal/non-consensual Content and disagree with our appeal response.

5. Appeal Procedure

Appeals must be submitted using the Deactivation Appeal Form.
No other method will be considered valid.

6. Required Information

Your appeal must include:
a) The URL or username of the account.
b) The URL of the Content subject to appeal.
c) Detailed reasons why the Content or account complies with the Terms of Service and Acceptable Use Policy.
d) For non-EarnOn Users: why the Content is illegal or non-consensual.

Only fully completed forms will be considered.

7. Timing

Appeals must be filed within six months of the Decision.

8. Review Process

Once a completed appeal is received:
- We will review relevant account information.
- We may request additional information from you or third parties.
- We will decide to grant, grant in part, or deny the appeal.

You will be notified of the outcome:
- Granted: Decision is reversed.
- Partially granted: Some Decisions reversed.
- Denied: No change.

9. No Liability

We are not liable for any interruption to your account, including lost earnings or subscribers, even if your appeal is granted.

10. Appeals Team

Appeals are handled by our Appeals Team in a non-discriminatory, diligent, and non-arbitrary manner.

11. Non-Appealable Decisions

This Policy does not apply to irreversible actions (e.g., ending a livestream in progress).

1. Introduction

The EarnOn eWallet is a closed-loop digital wallet hosted on https://earnon.ai. It is designed exclusively for transactions within the EarnOn platform, including payments for content, subscriptions, and services offered by creators, and for receiving Creator earnings.

- The eWallet provides a secure, cost-effective, and fast method for in-platform transactions.
- The eWallet is not a bank account, prepaid card, or open-loop e-money instrument, and funds stored in it are not FDIC-, FSCS-, or DICGC-insured.
- The eWallet may not be used for third-party payments outside EarnOn. Any such use is a violation of these Terms and the EarnOn Terms of Use.

This document constitutes an electronic record under the Information Technology Act, 2000, the U.S. Stored Value & Money Transmission Regulations, and comparable global standards.

2. Scope of Policy

2.1. Applies to all eWallet transactions including top-ups, payments, withdrawals, and Creator payouts.
2.2. All eWallet usage is subject to these Terms, the EarnOn Terms of Use, Privacy Policy, and Payment Policies.
2.3. EarnOn reserves the right to block, freeze, or terminate accounts engaged in misuse or non-compliance.

3. Definitions

- User: Any registered EarnOn member (Subscriber, Creator, or Referring User).
- eWallet: The closed-loop wallet for internal EarnOn transactions.
- Top-up: Adding funds to the eWallet account.
- Creator: EarnOn users who publish content or services and receive payments.
- Subscriber: Users who pay Creators using the eWallet.
- Platform Fees: Service charges deducted by EarnOn.
- Withdrawals: Transfers of available balances from eWallet to verified bank accounts or other permitted payout methods.
- KYC (Know Your Customer): Identity verification required prior to withdrawals.
- AML (Anti-Money Laundering): Monitoring obligations under FATF and national AML/CFT laws.

4. Funding & Payments

4.1. Users may fund their eWallet using approved methods (cards, bank transfers, UPI, PayPal, crypto where permitted by law).
4.2. Sufficient balance must be maintained to complete transactions.
4.3. Payments are instant and final, subject to EarnOn’s Refund Policy.
4.4. Platform Fees are deducted from each transaction.
4.5. EarnOn may set limits based on user verification, AML risk, and regulatory obligations.

5. Payouts & Withdrawals

5.1. Creators may withdraw available balances to verified accounts.
5.2. Withdrawals are processed in 3–5 business days, subject to banking networks and compliance checks.
5.3. KYC verification is mandatory before payouts.
5.4. EarnOn may delay or block withdrawals where fraud, AML violations, or chargebacks are suspected.
5.5. Inactive balances held for 12 months may be subject to maintenance fees or forfeiture in line with local law.

6. Refunds & Chargebacks

1. Expected Behaviour

         Treat all EarnOn users with respect, professionalism, and courtesy.

         Do not post, transmit, or share defamatory, obscene, profane, offensive, threatening, harassing, racially offensive, hateful, or otherwise illegal content.

         Do not impersonate others, provide false or misleading information, or infringe on intellectual property rights.

         Do not share private or personal contact details (address, phone, email, social media) in public areas or with users who have not directly interacted with you.

         Respect the privacy and consent of other users; cease contact immediately if asked to stop.

         Do not upload viruses, malware, or otherwise compromise the security of EarnOn.

2. Prohibited Conduct

         Using bots, scraping tools, reverse-engineering, or data mining EarnOn.

         Posting content that violates copyright, trademarks, or other third-party rights.

         Harassment, stalking, or abusive behaviour towards other users or EarnOn staff.

         Promoting illegal services, drugs, weapons, or gambling.

         Using EarnOn to disrupt public order or commit unlawful acts.

         Misuse of written spaces on EarnOn to spread inappropriate or false content.

3. Safety Precautions

         EarnOn does not conduct criminal background checks on users. Exercise caution in all interactions.

         Users assume all risks of meeting or interacting with others online or offline.

         Parents may request deletion of accounts if a minor has misrepresented their age. EarnOn strictly prohibits accounts for users under 18.

         Users are solely responsible for their safety when engaging with others on or off the platform.

4. Payments & Subscriptions

         In-app purchases are billed through your app store account (Apple, Google Play, or others). Subscriptions auto-renew until cancelled through your app store settings.

         Deleting your EarnOn account does not cancel your subscription; cancellation must be done through your IAP account.

         Payments are non-refundable unless required by law (e.g., refund requests made within 14 days in certain jurisdictions).

5. License to Use Content

         By uploading content, you grant EarnOn a free, non-exclusive, worldwide license to use, display, translate, and adapt the content solely for platform functionality, community interaction, and marketing purposes.

         India: Governed by the Information Technology Act, 2000, and the Arbitration and Conciliation Act, 1996, with jurisdiction in Hyderabad.
