1. Introduction, Purpose & Legal Binding Effect

These Terms of Service (“Terms”, “Terms of Use”, or “Agreement”) constitute a legally binding agreement between you (“User”, “you”, or “your”) and EarnOn.ai governing your access to and use of the EarnOn.ai platform, including its website, mobile applications, dashboards, APIs, tools, and related services (collectively, the “Platform”).

EarnOn.ai is operated by:

These entities are collectively referred to as “EarnOn.ai,” “we,” “us,” or “our.”

By accessing, registering on, or using the Platform in any manner, you confirm that you have read, understood, and agreed to be bound by these Terms.
If you do not agree, you must not access or use the Platform.

 

2. Structure of the EarnOn.ai Legal Framework

Your contractual relationship with EarnOn.ai consists of the following documents, collectively referred to as the “EarnOn.ai Agreement”:

2. Contract Between Subscriber and Creator
3. Platform-to-Business Regulation Terms
4. Referral Program Terms
5. Complaints Policy
6. E-Wallet Terms and Conditions
7. Tax & Applicable Charges Policy

Certain additional policies (including Acceptable Use, Refunds, Copyright & DMCA, Appeals, and Community Guidelines) are published as independent, standalone policies and apply by reference, without duplication in this document.

In the event of any inconsistency, these Terms of Service prevail, unless applicable law requires otherwise.

 

3. Nature of the Platform & Intermediary Disclaimer

EarnOn.ai is a technology-enabled marketplace and facilitation platform.

3.1 What EarnOn.ai Does

EarnOn.ai provides digital infrastructure that enables:

• Creators and service providers to offer content or services;
• Subscribers and consumers to access or purchase such offerings;
• Payments, subscriptions, wallet transactions, and discovery tools.

3.2 What EarnOn.ai Does NOT Do

EarnOn.ai:

• Does not create, produce, verify, supervise, or endorse content or services;
• Does not employ Creators or service providers;
• Is not a party to Creator–Subscriber contracts;
• Does not guarantee outcomes, quality, legality, or performance.

All interactions occur directly between Users, and Users act independently.

 

4. Eligibility & Account Registration

 

4.1 General Eligibility

To use EarnOn.ai, you must:

• Be at least 18 years old;
• Have legal capacity to form contracts;
• Not be prohibited by law, sanctions, or court orders;
• Provide accurate, current, and complete information;
• Comply with all applicable laws and regulations.

EarnOn.ai reserves the right to approve, reject, suspend, or terminate any account at its sole discretion.

 

4.2 Subscriber Accounts

Subscribers may:

• Register an account;
• Purchase subscriptions, content, or services;
• Manage billing and payment methods;
• Use the Platform for lawful purposes.

 

4.3 Creator Accounts

Creators must additionally:

• Complete identity and age verification;
• Provide payout and tax information;
• Set pricing independently;
• Upload content lawfully;
• Maintain compliance with EarnOn.ai requirements.

Failure to maintain eligibility may result in restrictions or termination.

 

5. User Obligations & Representations

By using EarnOn.ai, you represent and warrant that:

• All information you provide is truthful and accurate;
• You will not misuse the Platform;
• You will not attempt to circumvent fees, safeguards, or controls;
• You will comply with all applicable laws and platform requirements.

You are solely responsible for your conduct on and off the Platform.

 

6. Content Ownership, Responsibility & Risk Allocation

6.1 Ownership

Creators retain ownership of their content.
Uploading content does not transfer ownership to EarnOn.ai.

6.2 Responsibility

Creators are solely responsible for:

• Content legality and accuracy;
• Rights, licenses, permissions, and consents;
• Compliance with law and third-party rights.

EarnOn.ai does not pre-screen content and disclaims responsibility for user-generated material.

 

7. License Granted to EarnOn.ai

By uploading content, you grant EarnOn.ai a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, display, distribute, and process such content solely for operating, improving, promoting, and securing the Platform.

This license survives account termination where retention is required by law or legitimate business necessity.

 

8. Subscriptions, Payments & Pricing

8.1 Payments

• Payments are processed by third-party providers;
• EarnOn.ai deducts a 10% platform fee;
• 90% constitutes Creator Earnings, subject to taxes and adjustments.

8.2 Subscriptions

• Subscriptions automatically renew unless cancelled;
• Cancellation stops future billing only;
• Access continues until the billing cycle ends.

 

9. EarnOn.ai e-Wallet

The EarnOn.ai e-Wallet:

• Is a closed-loop wallet;
• Is not a bank account;
• Does not earn interest;
• Is governed by separate e-Wallet Terms.

Wallet misuse may result in restrictions or forfeiture.

 

10. Creator Earnings, Holding Periods & Payouts

• Earnings may be subject to a holding period (5–21 days);
• Minimum payout thresholds apply;
• Payouts may be delayed for fraud, disputes, or compliance;
• Charge backs may offset balances.

All payouts are final once completed.

 

11. Taxes & Regulatory Compliance

• Users are solely responsible for their own taxes;
• EarnOn.ai may collect, withhold, or report taxes where required;
• Failure to comply may result in restrictions or termination.

EarnOn.ai does not provide tax advice.

 

12. Suspension, Restriction & Termination

EarnOn.ai may suspend or terminate accounts:

• For breach of these Terms;
• For suspected fraud or illegal activity;
• To comply with legal obligations;
• Without notice for serious violations.

Fraud-derived earnings may be forfeited.

 

13. Intellectual Property (Platform IP)

Except for user-generated content:

• EarnOn.ai owns all rights to its software, branding, systems, and data;
• No rights are granted except as expressly stated.

 

14. Disclaimers

The Platform is provided “as is” and “as available.”
EarnOn.ai disclaims all implied warranties to the maximum extent permitted by law.

 

15. Limitation of Liability

To the maximum extent permitted by law:

• EarnOn.ai is not liable for indirect or consequential damages;
• No guarantee of uninterrupted service;
• Liability caps apply based on user type and jurisdiction.

Mandatory consumer rights are not affected.

 

16. Indemnification

You agree to indemnify and hold harmless EarnOn.ai from claims arising from:

• Your use of the Platform;
• Your content or services;
• Your breach of these Terms;
• Your violation of law or third-party rights.

 

17. Modifications to the Terms

EarnOn.ai may update these Terms at any time.
Continued use constitutes acceptance.

 

18. Governing Law & Dispute Resolution

India

• Governed by Indian law;
• Arbitration under the Arbitration and Conciliation Act, 1996;
• Seat: Hyderabad, India.

United States & Global

• Governed by Illinois law;
• Exclusive jurisdiction: Chicago, Illinois;
• Mandatory local consumer protections apply where required.

 

19. Assignment & Severability

• You may not assign your rights without consent;
• EarnOn.ai may assign freely;
• Invalid provisions do not affect the remainder.

 

20. Entire Agreement

These Terms constitute the entire agreement between you and EarnOn.ai, superseding all prior understandings.
